We have reviewed your section 510(k) premarket notification of intent to market the device referenced above and have determined the device is substantially equivalent (for the indications for use stated in the enclosure) to legally marketed predicate devices marketed in interstate commerce prior to May 28, 1976, the enactment date of the Medical Device Amendments, or to devices that have been reclassified in accordance with the provisions of the Federal Food, Drug, and Cosmetic Act (the Act) that do not require approval of a premarket approval application (PMA). You may, therefore, market the device, subject to the general controls provisions of the Act. Although this letter refers to your product as a device, please be aware that some cleared products may instead be combination products. ### 7.1. Software

The VertigoDx App is a mobile Software as a Medical Device (SaMD), compliant to IEC 62304, is intended to assist healthcare professionals in documenting, organizing, and supporting the clinical assessment of vertigo and balance disorders. The software performs structured data capture, symptom documentation, guided test documentation, and report generation for clinician review. Similar to the identified predicate device, the VertigoDx App provides decision-support functionality based on clinician-entered data and does not independently diagnose, treat, or control therapy. The clinician remains responsible for clinical interpretation and final medical decision-making.

### 7.2. Illumination

The SmartVertigo Vestibular Assessment System utilizes the display illumination of a commercially available smartphone (iPhone 14 Pro Max) as a low-intensity, diffuse white-light source to illuminate the peri-ocular region during video capture of eye movements. The system operates at a fixed distance of 9 cm from the subject's eyes, producing an illuminance of 17–40 lux and luminance of 5–13 cd/m², with no UV or IR emissions. Testing was conducted using a Digital Lux Meter (model LX1330B) under controlled conditions to measure light output and assess compliance with applicable photobiological safety standards, including ANSI Z80.36-2021 and IEC 62471:2006.

Based on luminance measurements and comparison with these standards, the SmartVertigo Vestibular Assessment System qualifies as an Exempt light source (RG0) with no risk of blue-light retinal, thermal retinal, UV, or IR hazards. Exposure duration is limited to 2-minute intervals per test, with a maximum cumulative exposure of 14 minutes, ensuring retinal exposure remains far below defined hazard thresholds. ### 7.3. Human Factors/Usability

A summative usability validation study for the SmartVertigo was conducted in compliance with IEC 62366-1:2015+A1:2021 and FDA Guidance, "Applying Human Factors and Usability Engineering to Medical Devices," to support safe and effective use by its intended user population (clinicians, technicians, healthcare personnel). Fifteen participants, aged 22–58 years, completed critical tasks using the finalized Instructions for Use (IFU) without coaching. All participants achieved ≥76% task success, with a mean score of 43.7/50, and no non-recoverable or critical errors were observed. Minor recoverable errors, such as headset adjustment and software navigation, were resolved using the IFU, which was rated 100% clear, easy to read, and helpful.

### 8. Conclusion

The subject and predicate devices have the same intended use, similar technological characteristics, and the same fundamental scientific principles of operation. The minor differences in illumination source, data handling configuration, and clinical setting are addressed by the non-clinical and HF testing described above and do not introduce different questions of safety or effectiveness.
